Client Stream Israel Terms of Service

These Terms of Service ("Terms") govern your use of Client Stream Israel websites, subdomains, landing pages, opt-in pages, free trainings, masterclasses, forms, booking pages, sales-call scheduling pages, training portals, student-access pages, emails, messages and other public, pre-enrollment or access-related services operated by Client Stream Israel, including pages hosted at clientstream.me, training.clientstream.me or other Client Stream-related domains or subdomains we use from time to time (collectively, the "Site").

Client Stream Israel is operated by David Bederman / דוד בדרמן, עוסק מורשה מס' 320806177, C/O Attorney Adi Rosenstein, Alon Building 2, 94 Yigal Alon Street, 11th Floor, Tel Aviv-Jaffa 6744320, Israel ("Client Stream," "we," "us" or "our").

By using the Site, submitting a form, registering for a free training, booking a call or communicating with us, you agree to these Terms.

These Terms govern general use of the Site and public, pre-enrollment and access-related services. They do not describe the full commercial terms of any paid Client Stream program. No person may enroll in or pay for a paid Client Stream program unless they first sign or clearly accept the separate paid enrollment agreement presented at signup. Paid enrollment, price, VAT treatment, payment, delivery, cancellation, refund, recording, replay access, WhatsApp/community, AI-tool, testimonial and participant obligations will be governed by that separate paid enrollment agreement. If there is a conflict between these public Terms and a signed or clearly accepted paid enrollment agreement, the paid enrollment agreement will govern the paid program, except where mandatory law provides otherwise.

1. Mandatory Israeli Rights

Nothing in these Terms, any checkout page, webinar, sales call, email, WhatsApp message, SMS message, application, registration form or enrollment agreement limits any cancellation, refund, disclosure, accessibility, privacy, marketing-message or other right that cannot legally be waived under Israeli law.

Where Israeli consumer-protection law gives a consumer a greater right than these Terms, the mandatory legal rule will apply.

If you purchase a paid Client Stream program, the applicable price, VAT treatment, payment schedule, service start date, digital-access start date, live-call entitlement, cancellation procedure, refund treatment and any statutory cancellation rights will be disclosed in the paid enrollment agreement, transaction document or other required pre-purchase disclosure.

2. Educational Information Only

Client Stream provides business, marketing and sales education and training. The Site is intended to share educational content about offers, messaging, client acquisition, sales conversations, webinars, funnels, tracking, business positioning and related business topics.

Client Stream is not a business opportunity, franchise, employment opportunity, investment, "get rich quick" program or guaranteed income system.

Client Stream does not provide legal, tax, accounting, investment, financial, medical, therapeutic, psychological or other regulated professional advice. You remain responsible for your own business decisions, advertising claims, expenses, compliance obligations, sales practices and results.

3. No Professional Relationship Created

Use of the Site, attendance at a free training, submission of an application, participation in a sales call, receipt of educational materials or communication with Client Stream does not create an attorney-client, accountant-client, therapist-client, medical-provider, investment-adviser, employment, partnership, franchise, agency, fiduciary or other regulated professional relationship.

4. No Guaranteed Results; Examples Are Not Typical

We do not promise or guarantee clients, leads, sales, revenue, profit, return on investment, business growth, personal transformation or any specific business, financial, personal or professional result.

Any examples, testimonials, case studies, statements, figures, depictions, screenshots or participant stories are individual experiences only. They are not promises, typical results, forecasts or guarantees. Your results depend on your effort, skill, implementation, offer, market, pricing, timing, advertising platforms, available time, business model, economic conditions and other factors outside our control.

You should not rely on any statement on the Site, in a free training, webinar, email, WhatsApp message, SMS message, sales call, application page, marketing material or other communication as a guarantee of outcome, unless a specific guarantee is expressly stated in a written agreement signed or clearly accepted by us.

5. Eligibility

The Site is intended for users who are at least 18 years old. Do not submit forms, book calls or use our services if you are under 18.

6. Free Trainings, Forms, Applications and Sales Calls

We may offer free trainings, masterclasses, booking forms, application forms, emails, messages and sales calls. These are for informational and educational purposes and do not guarantee acceptance into any paid program, availability of any offer or any specific result.

If you register for a free training, webinar, masterclass or similar event, we may send you access links, reminders, replay links, related educational materials and follow-up messages connected to that registration. Free webinar or training replays may be sent to registrants or people who requested access.

Application forms, booking forms, surveys, questionnaires, emails, WhatsApp messages or other communications may ask for or receive information about your business, income, goals, challenges, emotional state, relationships, health, therapy-related background, personal circumstances or other sensitive or private matters. Please share only information that is truthful, relevant and necessary for your inquiry. Do not submit medical records, therapy records, legal documents, full identity documents, credit-card numbers, bank-account details, passwords, confidential third-party information or client-identifying information unless we specifically request it and provide appropriate instructions.

7. Recording Notice

Free trainings, webinars, sales calls, Zoom calls, paid program calls, support sessions and other live or online sessions are recorded or may be recorded after notice is given, unless recording without notice is permitted by applicable law.

If you do not want to be recorded, do not join or continue the recorded session. Because recording is part of how we operate, we may not be able to provide a non-recorded alternative unless required by law or separately agreed in writing.

Recordings may include your name, image, voice, chat messages, questions, comments, business information, personal information and other information you choose to share during the session.

Free webinar or training recordings and replays may be sent or made available to registrants or people who requested access. Sales-call recordings are for internal use, customer support, quality assurance, legal compliance, dispute handling, evidence, fraud prevention and protection of our rights, unless you separately consent to another use.

Paid program call recordings may be made available to paid participants in the applicable program, cohort, access group or membership area. If you participate in a paid live call, your name, image, voice, chat messages, questions, comments, business information and other information you share may be visible or audible to other paid participants through the live session or recording.

Do not share confidential, sensitive, third-party, client-identifying, medical, therapeutic, legal, financial or private information during calls unless you are comfortable with that information being heard by other participants and potentially appearing in the recording.

We will not use your name, image, voice, testimonial, story, business results, screenshot or identifiable participant content in public marketing without your separate consent. Paid-program recording access, replay access and participant visibility will be governed by the paid enrollment agreement.

8. Marketing Messages, Email, SMS and WhatsApp

We may send you service messages related to a registration, booking, training, application, call, transaction, legal notice or customer-service issue.

We will send promotional messages by email, SMS, WhatsApp or similar electronic means only where we have a lawful basis to do so, including your consent where required by Israeli law. Promotional messages may include training reminders, webinar follow-up, invitations, offers, program information and related business education.

You may opt out of promotional messages at any time by clicking an unsubscribe link where available, replying "STOP" or "הסר" where technically available, or contacting support [at] clientstream [dot] me. Opting out of promotional messages does not prevent us from sending non-promotional service, transaction, legal or administrative messages.

9. Privacy and Databases

Our collection and use of personal information is governed by our Privacy Policy. The Privacy Policy explains what information we collect, why we collect it, how we use it, who may receive it, where it may be processed or stored, how long we keep it, and how you may contact us about privacy requests.

Do not submit sensitive personal, medical, therapeutic, psychological, financial, legal, confidential third-party or client-identifying information unless specifically requested and necessary for the purpose of your inquiry.

We may use software tools, automation, AI tools, custom GPTs, analytics tools or third-party service providers to help process inquiries, analyze application forms, organize information, draft responses, improve materials, provide educational support, support operations or deliver services. This may include processing personal information you submit to us, including business information, application answers, goals, challenges, preferences, communications and other information you choose to provide.

Where we use AI or software tools with personal information, we aim to limit the information shared to what is reasonably necessary for the relevant purpose. AI-generated or software-assisted outputs may be incomplete, inaccurate or inappropriate and should not be treated as legal, tax, accounting, financial, medical, therapeutic, psychological or other regulated professional advice.

We do not intentionally store full payment-card details. Payment information, where applicable, is handled by third-party payment processors subject to their own terms, privacy policies and security practices.

10. Intellectual Property

All Site content, including text, videos, training materials, graphics, frameworks, scripts, templates, copy, logos, trade names and designs, is owned by us or our licensors and is protected by copyright, trademark and other laws.

You may view the Site for your own personal, non-commercial educational use. You may not copy, reproduce, share, sell, license, publish, teach, distribute, upload, scrape, modify, reverse engineer, create derivative products from or otherwise exploit our content except as expressly allowed in writing.

11. User Submissions

If you submit a form, application, message, comment, testimonial, question, business information, result, screenshot or other material to us, you confirm that the information is accurate to the best of your knowledge and that you have the right to share it with us.

You agree not to submit unlawful, misleading, infringing, confidential, abusive, discriminatory, defamatory, harmful or spam content.

We may use submissions to respond to you, evaluate your inquiry, provide free or pre-enrollment services, improve our content, protect our rights and operate our business, as described in our Privacy Policy. Any broader paid-program recording, testimonial, publicity or participant-content rights will be addressed in the paid enrollment agreement or a separate consent.

12. Prohibited Conduct

You agree not to:

  • misuse the Site or interfere with its operation or security;
  • copy, scrape, distribute or commercially exploit our content;
  • submit false, misleading, unlawful, infringing or harmful information;
  • impersonate another person or misrepresent your identity;
  • harass, abuse, defame, threaten or discriminate against us or others;
  • use the Site to violate advertising, privacy, consumer-protection, spam, intellectual-property or other laws;
  • make false claims about your results, our content or our programs.

13. Third-Party Platforms and Links

The Site may use or link to third-party platforms such as website providers, Zoom, WhatsApp, payment processors, scheduling tools, email providers, CRM tools, analytics tools, advertising platforms and social media platforms. We are not responsible for third-party availability, security, privacy practices, policies, fees or changes. Your use of third-party platforms may be subject to their own terms and policies.

14. Accessibility

We aim to provide an accessible website and digital service experience in accordance with applicable Israeli accessibility requirements. If you have difficulty accessing any page, form, training, booking process, document, video or other digital material, contact support [at] clientstream [dot] me and we will make reasonable efforts to provide assistance or an accessible alternative.

Where legally required, we will publish and maintain an accessibility statement describing the accessibility adjustments made, known limitations and accessibility contact details.

15. Disclaimers

To the maximum extent permitted by law, the Site and free materials are provided "as is" and "as available."

We do not guarantee that the Site, training portal, student-access pages, recordings, replays or third-party platforms will be uninterrupted, error-free, available at all times, compatible with every device or platform, or free of technical problems.

We do not guarantee ad approvals, platform performance, lead quality, sales conversion, customer behavior, revenue, profit, market response, legal compliance of your own business, or the outcome of any funnel, script, webinar, sales process or marketing activity.

You are responsible for checking current rules before running ads, sending marketing messages, making claims, selling your own services, using tools or implementing any funnel, script, template or strategy.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Client Stream, David Bederman and anyone working with us will not be liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost revenue, lost business opportunity, lost data, loss of goodwill, advertising costs, implementation costs or decisions you make based on free educational materials.

To the maximum extent permitted by law, our total liability for claims relating to the Site or free materials will not exceed the amount you paid us, if any, for the specific Site or free service giving rise to the claim.

Nothing in these Terms excludes or limits liability where exclusion or limitation is not permitted by Israeli law, including liability for fraud, intentional misconduct, bodily injury caused by negligence where applicable, or any non-waivable consumer right.

17. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless Client Stream, David Bederman and anyone working with us from claims, losses, damages, liabilities, costs and expenses, including reasonable legal fees, arising from your breach of these Terms, misuse of the Site, unlawful conduct, advertising or sales practices, business claims, infringement of rights or violation of law. This indemnity does not apply where prohibited by law.

18. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted with a new "Last updated" date. Continued use of the Site after an update means you accept the updated Terms, to the extent permitted by law.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules.

Before bringing a legal claim, you agree to contact us at support [at] clientstream [dot] me and give us a reasonable opportunity to address the issue informally. This does not limit any non-waivable right you may have under Israeli law.

Subject to applicable law, disputes will be brought in the competent courts of Israel. Nothing in this section limits a consumer's non-waivable rights regarding where or how a claim may be brought.

20. Language

These public Terms are currently provided in English only. By using the Site, submitting a form, registering for a free training, booking a call or communicating with us, you confirm that you can read and understand English, or that you have obtained appropriate assistance before using the Site.

Paid enrollment agreements may be provided in Hebrew where available or where required by law. The controlling language for any paid enrollment agreement will be stated in that paid agreement. If a Hebrew version of these public Terms is provided in the future, we will state which version controls.

21. Contact, Cancellation Notices and Legal Notices

Our official contact methods for public Site questions, privacy requests, marketing opt-outs, cancellation notices and legal notices are email and written mail only.

We may communicate with you through email, WhatsApp, SMS, phone, Zoom, platform notifications or other channels where appropriate, but unless we expressly state otherwise in writing, those channels are not official channels for legal notices, cancellation notices or privacy requests.

A cancellation notice should include the purchaser's full name, phone number, email address used for registration, transaction date, program name and a clear statement that the purchaser wishes to cancel. We may request reasonable identifying details only to locate the transaction and process the request.

These public Terms explain how cancellation notices may be sent. Any cancellation right, refund right or cancellation fee will be determined by applicable law and, for paid programs, the paid enrollment agreement or required transaction disclosure.

22. Miscellaneous

If any provision is found unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law. Our failure to enforce a provision is not a waiver.

You may not assign your rights or obligations without our written consent. We may assign our rights or obligations as part of operating, restructuring or transferring the business, subject to applicable law.
